Terms and Conditions


Scope and Interpretation

These Terms and Conditions apply exclusively to purchases made by private consumers (“Consumers”) via www.florovia.com. They govern the sale of goods by Florovia AB (“Florovia”, “We”, “Us”) to consumers.

A “Consumer” means a person acting for purposes outside their trade, business or profession.

“Goods” refers to any physical products offered for sale by Florovia through the website.

By placing an order on www.florovia.com, you enter into a binding purchase agreement with Florovia and agree to these Terms and Conditions. If you do not agree with them, you must not place an order.

These Terms and Conditions apply to each individual purchase. Matters relating to personal data, cookies, and general use of the website are regulated separately in our Privacy Policy.

Information about products and orders may be provided via the website or by email. In the event of any inconsistency between these Terms and Conditions and information presented in marketing or promotional materials, these Terms and Conditions shall prevail.

Florovia reserves the right to update these Terms and Conditions. Any changes will apply only to purchases made after the updated version has been published on the website.

Goods, Orders and Payments

Order Confirmation and Contract Formation  

When you place an order on www.florovia.com, your order constitutes an offer to purchase goods from Florovia. A binding purchase agreement is formed when we send you an order confirmation by email to the email address provided at checkout.

If you do not receive an order confirmation within a reasonable time, please check your spam folder or contact us at info@florovia.com.

Product Availability and Pricing 

All orders are subject to product availability. In the event of pricing errors, incorrect product information or stock discrepancies, Florovia reserves the right to correct such errors. If an error affects your order, you will be informed without undue delay and given the option to confirm the correct order or cancel it. In case of cancellation, any payment made will be fully refunded.

All prices are stated in Swedish kronor (SEK) and include 25% Swedish VAT, unless otherwise stated. Orders within the European Union should not be subject to additional taxes, however, for deliveries outside the EU, customs duties or import taxes may apply in accordance with local regulations. Florovia cannot be held responsible for any delay at customs, and such import taxes are the responsibility of the buyer. 


Payment  

By placing an order, you authorize Florovia to charge the full purchase amount using the selected payment method. We accept MobilePay, Apple Pay, PayPal, Visa, MasterCard, Shop Pay, Klarna, Paypal, iDEAL. Payment is required at the time of order placement.

You expressly acknowledge and accept that payment will be charged immediately upon placing the order, including for pre-order items that are not yet in stock.

Customer Responsibility  

The customer is responsible for ensuring that all contact and delivery information provided at checkout is accurate and complete. Florovia is not responsible for delays or delivery issues resulting from incorrect or incomplete information provided by the customer.

Product Information and Variations  

All products are sold based on the descriptions and images presented on the website at the time of purchase. We always strive to ensure that all the product details, prices and descriptions on our website or in any marketing material are accurate at the time of entering them into our systems or printing our materials. While we make every effort to display products accurately, minor deviations may occur.

Many of Florovia’s products are handmade, which means slight variations in color, shape or finish may occur. Such variations are a natural characteristic of handmade products and do not constitute defects. 


Risk and Ownership

Transfer of Risk

The risk of loss or damage to the goods transfers to the customer when the goods are physically received by the customer or by a person designated by the customer at the delivery address, in accordance with applicable consumer protection law.

Transfer of Ownership

Ownership of the goods remains with Florovia until full payment for the goods has been received. Once full payment has been made, ownership of the goods is transferred to the customer.

Delivery and Shipping

Delivery Conditions

All floral stems and arrangements provided by Florovia are packaged with care in Sweden. Unless otherwise stated, orders containing multiple items may be shipped together in a single package. If you are purchasing a gift and require separate packaging, please leave a comment at checkout.

Due to the nature of packaging and transport, creasing of wrapping materials may occur during transit. Such cosmetic effects do not affect the product itself.

We recommend following our care guidelines to maintain the quality and longevity of your Florovia flowers.

Delivery Times

Florovia delivers to selected European countries via dB Schenker and to destinations outside Europe via UPS. Estimated delivery times are provided at checkout and are indicative only.

The estimated delivery time is normally 2–8 business days from dispatch. In periods of high order volume or other exceptional circumstances, delivery may take longer. If a significant delay occurs, Florovia will inform the customer without undue delay.

Florovia remains responsible for delivery of the goods to the customer in accordance with applicable consumer protection law but is not liable for delays caused by dB Schenker or other third-party carriers.

Failed or Delayed Delivery  

If delivery is unsuccessful due to incorrect or incomplete address information provided by the customer, Florovia may charge the customer for any additional shipping or handling costs incurred.

If the delivery of an order is significantly delayed and the customer no longer wishes to proceed with the purchase, the customer has the right to cancel the order and receive a full refund. For significantly delayed or missing orders, please contact us at info@florovia.com.

Pre-Orders  

Products marked as pre-orders are not in stock at the time of purchase and will be shipped once available. Estimated delivery dates are provided for guidance only and may change due to production schedules or other factors beyond Florovia’s control.

Payment for pre-order items is charged at the time the order is placed. If an order contains both in-stock and pre-order items, the order will normally be shipped once all items are available, unless otherwise stated.

In the event of a significant delay, Florovia will inform the customer and offer the option to cancel the pre-order. Any cancelled pre-order will be refunded without undue delay.

Shipping Costs and Taxes  

Shipping costs are calculated automatically at checkout based on the delivery address.

All prices include Swedish VAT (25%), unless otherwise stated. For deliveries outside the European Union, customs duties or import taxes may be imposed by local authorities and are the responsibility of the customer. Florovia does not cover or influence these fees. We recommend contacting your local customs office for specific details regarding applicable charges before placing an order.


Return and Refund Policy

14-day-Right of Withdrawal

Consumers worldwide have the right to withdraw from their purchase within fourteen (14) days from the day the goods are received by the consumer, or by a person designated by the consumer.

If an order consists of multiple items delivered separately, the withdrawal period begins on the day the last item is received.

To exercise the right of withdrawal, the consumer must inform Florovia of their decision to withdraw within the 14-day period by email to info@florovia.com.

The right of withdrawal does not apply to custom-made or personalized products.


Condition of Returned Goods

During the withdrawal period, the consumer may examine the goods to the extent necessary to establish their nature, characteristics and functioning. The consumer is responsible for any diminished value of the goods resulting from handling beyond what is necessary for such examination.

Products must be returned in the same condition as when purchased with all original tags and labels attached.

Florovia reserves the right to reject returns or issue a partial refund in the following cases:

  • The item has been used or washed.

  • The original product packaging (including stickers) is broken or missing.

  • The item is damaged or shows visible signs of wear and use.

It is the customer’s responsibility to ensure that the goods remain in original condition until they are returned.


Refunds

After receiving your return and inspecting the condition of your item, we will process your refund. Please allow at least 7 days from the receipt of your return for processing. Refunds are issued using the same payment method used for the original transaction, unless otherwise agreed. Please note that it may take time for the refund to appear in your account, depending on your payment provider. 

If your return is approved, the refund will be processed, and a confirmation email will be sent to you. If you have not received a confirmation email within a reasonable timeframe, please check your spam folder or contact us at info@florovia.com for assistance. 

If a return results in the total order value falling below the free shipping threshold (SEK 1,300), Florovia reserves the right to deduct the original shipping cost from the refund.


Return process

SWEDEN

Customers in Sweden may return items using Florovia’s return portal. A return shipping label will be provided, and the return shipping fee will be deducted from the refund. You can find the return portal here: Return Portal


OTHER COUNTRIES

For returns from countries other than Sweden, customers must contact Florovia at info@florovia.com before returning any item in order to receive the correct return address and instructions.

Return shipping costs are non-refundable, meaning the customer is responsible for all associated return shipping costs.

The customer is responsible for the return parcel until it has been received by Florovia. We recommend using a trackable shipping method and retaining proof of shipment until the refund is processed. Important note: return parcels cannot be sent to a pick-up point or post office; they must be sent directly to the designated address provided by customer service.


Failed Delivery

If an order is returned due to incorrect or incomplete delivery information provided by the customer, Florovia may offer to re-ship the order. In such cases, the customer is responsible for the additional shipping costs.

If an order is not collected from the designated pick-up point within the carrier’s time limit and is returned to Florovia, the customer is responsible for the return shipping costs and any additional handling costs incurred.

Claim policy

At Florovia, we strive to provide high-quality products and services. If you receive a defective or damaged item at the time of delivery, you have the right to file a claim in accordance with consumer protection laws.

For consumers in Sweden, claims may be made for up to three (3) years from the date the goods were received, in accordance with the Swedish Consumer Sales Act (Konsumentköplagen).

For consumers within the EU/EEA, claims may be made for up to two (2) years from the date the goods were received, in accordance with Directive (EU) 2019/771.

For consumers outside the EU/EEA, no statutory right to claim applies unless required by mandatory local law.


What Constitutes a Defect  

A defect includes:

  • Manufacturing defects or faults affecting the functionality or durability of the product  

  • Delivery of incorrect goods

A defect does not include:

  • Normal wear and tear

  • Damage caused by misuse, accidents, or failure to follow care instructions  

  • Minor variations in color, shape, finish, surface texture or detachable elements resulting from the handmade nature of the products  

  • Minor surface shedding or natural material characteristics  

  • Color variations caused by screen settings, monitor calibration or photography lighting conditions  

  • These characteristics are considered normal features of the product and do not constitute defects or grounds for claims, returns, or replacements. 


How to Submit a Claim:

Consumers should contact info@florovia.com within a reasonable time after discovering the defect and provide:

  • Order number

  • A description of the issue

  • Photos or videos of the defective or damaged item(s), reasonably necessary to assess the claim

  • Photos or videos of the packaging before opening the item (this is crucial for processing your claim)


Claim Handling:

Once your claim is reviewed, we will inform you of the next steps. 

If a claim is approved, Florovia will, in accordance with applicable law, offer repair, replacement or refund. Where a return is required, Florovia will cover reasonable return shipping costs and refund the original delivery cost.

If a claim is rejected because the goods are found to be free from defects covered by applicable law, shipping costs will not be reimbursed.

Florovia reserves the right to reject claims if the item does not meet the conditions stated above.


Damaged Products Policy

If a product arrives damaged because of transport, the consumer is entitled to remedies in accordance with applicable consumer protection law.

If your product arrives damaged, please follow these steps:

  • Immediate Inspection: upon delivery, inspect the packaging and product for any visible damage.

  • Documentation: take clear photos or videos of the packaging before opening it and of the product.

Consumers should contact info@florovia.com as soon as reasonably possible after discovering the damage and provide:

Florovia recommends consumers to retain original packaging materials until the matter has been resolved, as these may be required for inspection by the carrier.

Where a transport-related damage claim is approved, Florovia will, in accordance with applicable law, offer a repair, replacement or refund and cover reasonable return shipping costs where required.

By adhering to these guidelines, we aim to ensure a smooth and efficient resolution process for any issues you may encounter with our products.


Force Majeure

Florovia shall not be liable for delays or failure to perform its obligations where such delay or failure is caused by events beyond Florovia’s reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, governmental actions, pandemics, strikes, or other similar events (“Force Majeure”).

In the event of Force Majeure, Florovia will inform the customer without undue delay and take reasonable measures to mitigate the effects of the event.

Florovia’s obligations under the contract will be suspended for the duration of the Force Majeure event. If the Force Majeure event continues for a prolonged period and performance of the contract is no longer reasonably possible, the customer has the right to cancel the order and receive a full refund.


Limitation of Liability

Nothing in these Terms and Conditions shall limit or exclude Florovia’s liability where such liability cannot be limited or excluded under applicable consumer protection law, including liability for death or personal injury, product liability, or damage caused by gross negligence or willful misconduct.

To the maximum extent permitted by applicable law, Florovia shall not be liable for indirect or consequential damage suffered by the consumer, such as loss caused by interruptions to the website or technical errors beyond Florovia’s reasonable control.

Florovia does not guarantee that the website will be available at all times or free from errors. Temporary interruptions or technical issues may occur. This does not affect the consumer’s statutory rights or Florovia’s obligations under applicable law.

Integrity Policy

Personal data is processed in accordance with our Privacy Policy, which is available on www.florovia.com.


Intellectual Property

All intellectual property rights related to the website and its content, including but not limited to images, text, graphics, logos, designs and trademarks, are owned by or licensed to Florovia AB and are protected by applicable intellectual property laws.

Florovia grants consumers a limited, non-exclusive, non-transferable and non-commercial right to access and use the website and its content for personal use only.

Gift Card

At Florovia, you can purchase gift cards that can be used for purchases in our web shop. Gift cards are delivered via email and contain a unique code for redemption at checkout.

  • Validity: Gift cards are valid for one (1) year from the date of issue.

  • Non-Refundable: Gift cards cannot be exchanged for cash or refunded.

  • Partial Use: Gift cards may be used in full or in part. If the total purchase amount is less than the value of the gift card, the remaining balance may be used for future purchases until the expiration date.

  • Loss or Misuse: Florovia is not responsible for lost, stolen or misused gift cards codes. Gift cards should be treated as cash.

  • Application of Terms: Purchases made with gift cards are subject to the same delivery, return and claim rules as other purchases, where applicable.


Governing Law and Jurisdiction

These Terms and Conditions and any purchase agreement between the consumer and Florovia shall be governed by the laws of Sweden.

Any disputes arising in connection with these Terms and Conditions or a purchase agreement may be brought before the competent courts of Sweden or, where applicable, before the courts of the consumer’s country of residence, in accordance with applicable consumer protection law.

Changes to Terms

Florovia reserves the right to update these Terms and Conditions at any time. Any changes will apply only to purchases made after the updated version has been published on www.florovia.com.

By continuing to use our services, you agree to the revised terms.

Changes will not affect orders that have already been placed or contracts that have already been concluded.
